Diploma of Recognition to the Company For its commitment to train students of the Cicle Formatiu of Comercial Activities from the Institute Montgrí, in adequate working enviroment for thei training (FP Dual) On Wednesday, June the 6th, we celebrated the presentation of 4 business projects by four students in the second year of the Cicle Formatiu of Comrcial Activites course. The celebration wwas held at the Mediterranean Museum in Torroella de Montgrí. It was very intersting to sea diferent approaches from different points of view. At the end of the presentations dipolmas were given to all the companies that have had trainees in training for more than 1.000 hours. Cristina Collier, Inmocosta's trainee, handed me the diploma issude by the Institute of Torroella de Montgrí in collaboration with the Deparatment of Education of the Generalitat de Catalunya. Cristina has many more hours of training to complete and we are making sure that she is learining in the best professional enviroment.

In order to have the security of correct guidance in each of the stages, it is recommended that you use a Qualifield Estate Agent, an A.P.I., as both his experience and his professionalism are guarantees of a transaction which will be formal and without surprises. A private contract is enforceable before a Court of Law but has the handicap of not being registrable in the Property Register, a situation which could imply a problem, although a remote one. DEALING WITH THE TITLE DEED. TAXES Within one MONTH of being signed, the title deed must be submitted to the Settlement Office for payment of the Asset Transfer Tax. One is entitled to a 70% discount on the Asset Transfer Tax if he meets the following requirements: • It must involve the transfer of the fee simple of a property or part of a property for its use as a residence. • It is in favour of a Real Estate company whose main activity must be: the construction of buildings, real estate development, or the sale of properties on its own behalf. • The acquiring company in question must incorporate the property into its current assets for the purpose of reselling it. • The time frame for resale is set at 5 years (as of 1/1/2009), to be carried out in favour of: - A private party who uses it as his primary residence. - Another company that complies with the requirements indicated. * The deed is to document the intention to apply the fiscal discount. If after this period he fails to transfer the property to one of the preceding parties he is to present a declaration of the percentage outstanding, until reaching 10%, plus the corresponding interest for the delay. If it represents a new home the document must also be presented at the same Office, and within the same time frame, for payment of the Legal Acts Tax of 1.2%. However, in this case, he is to have paid the Value Added Tax, of 10%. The taxation terms governing Documented Legal Acts are as follows: -Waiving of the VAT exemption: 1.8% -Acquisition of housing declared to be “government-protected”: 0.1% -Mortgages for the acquisition of “government-protected” housing: 0.1% -Provisional filings: 0.5% -Groupings, divisions and aggregations of properties, declarations of newly built properties, the horizontal division of properties, adjudications, transfers subject to VAT, the constitution of mortgages, the modification of mortgages and other documented legal acts documented by a notary: 1.5%: (the scale has disappeared) The 5% rate is maintained for the Asset Transfer Tax for the acquisition of a primary residence by those ages 32 and younger. THE REGISTRY When the deed has been dealt with in the Cashier's Department of the autonomous government Tax Office it is advisable to present it to the Property Registry for it to be registered. The registration of the deed means thet the ownership of the property is recognised for all effects. Frequently the Cashier's Departement of th autonomous governement Tax Office and the Property Registry are at the same place. CHANGING THE NAME IN THE CADASTER Once the title deed has been registered in the Property Registry, there only remains going to the Cadaster in order to register the change of ownership for the purpose of th Property Tax so that the Property Tax Assessment notice will be issued in the name of the buyer. OBLIGATIONS OF THE SELLER It must also be remembered that the seller has to hand over the Hability Certificate (Cèdula d'Habitabilitat) as well as the First Occupacy Licence (Llicència de Primera Ocupació) issued by the Municipality where the dwelling is located. The Hability Certificate provides the purchaser with the guarantee that the dweling has the minimum conditions of habitability. In the case of new buildings the seller must also hand over the certificates from officially recognised installers (plumbers, electricians, etc.) Both the Hability Certificate and the First Occupancy Licence are necessary in the order to contract for the water, gas and electricity supplies. THE FINANCING It is of great importance to study which is the best way of financing the purchase with respect to each case and each particular time. The API, because he is continually in direct contact with the finance houses, will be in a position to supply you with the information you need.

Energetic Efficiency Certificate On the 5th of April of 2013 the Central Government published the "State Plan for Development of Rental Housing, Rehabilitation, Regeneration and Urban Renewal (2013-2016)" which it was published the day 13 of april of 2013 at the BOE by the Royal Decree 235/2013 by which approves the basic procedure for the certification of energetic efficiency of the buildings. From the 1st of june of 2013 will be obligatory to have the energetic certificate for buildings or homes which are sold or rented and for public buildings from more than 500m2. The energetic efficiency certificate should be valid for a maximum of 10 years. After this term, will be necessary to renew it. Also, the certificate could be renew voluntarily if there are variations in some aspects affecting the energetic efficiency and therefore they can modify their energetic rating and certificate. The qualification and the energetic certification of a building - The energetic certificated is a document that verifies the conformity of energetic qualification obtained and It is leading to the issuance of the label of energetic efficiency of the building. - The energetic label is the distinctive that marks the level of energetic efficiency qualification obtained for the building or parts of the building. El Instituto Nacional de Estadística (INE) ha confirmado que durante 2016 se llevaron a cabo 403.866 compraventas de casas en España. La cifra acumulada del pasado ejercicio arroja un crecimiento interanual del 13,6%, se convierte en la más alta desde 2010 (cuando la cifra se acercó a 440.000) y supera en un 1% la barrera de 400.000 transacciones que esperaba el mercado. Desde los mínimos de 2013, cuando apenas se cerraron 312.600 compraventas, el número de transacciones ha aumentado un 29,2%. Sin embargo, la cifra actual sigue un 48% por debajo de 2007, cuando se sellaron más de 775.000 operaciones. A pesar de todo, en España el nivel de herencias de viviendas es alto. Un gran porcentaje de residentes viven en casas propias y todas esas viviendas están destinadas a ser heredadas en algún momento. Dicho esto, veamos los impuestos que se deben pagar al heredar una vivienda: El Impuesto sobre Sucesiones y Donaciones (antes conocido como los derechos reales). Se trata de un impuesto progresivo y la valoración de la casa es dictada por la Consejería de Economía y Hacienda de la Comunidad Autónoma donde se encuentre la vivienda. Sobre ese valor se calcula el porcentaje del impuesto. Plusvalía municipal (El Impuesto sobre el Incremento del Valor de los Terrenos de Naturaleza Urbana). El valor es determinado por el Catastro y sobre éste se aplican los coeficientes en función del número de años que hayan transcurrido desde la anterior transición. Estos impuestos tienen un plazo de un semestre para ser liquidados desde que se produce la defunción, pudiéndose solicitar una prórroga por un periodo igual.
